The evidence an Italian property purchase turns on
Definition: Buying property in Italy requires confidence on six records before a binding commitment. Italian conveyancing distributes responsibility across several professionals and several public records. A buyer who does not know which record answers which question cannot tell an incomplete investigation from a complete one until the preliminary contract is already signed.
Title and the right to sell
The land registry record shows who holds title and on what basis. Inheritance, undivided co-ownership, matrimonial property regimes and pre-emption rights all decide who must sign for a valid transfer. The notary carries responsibility for confirming this before the deed.
Cadastral correspondence
The cadastral record describes the property for fiscal purposes: category, class, rooms, cadastral income and floor plan. Where the plan does not match the building, the mismatch must be resolved before a deed, normally by a surveyor or engineer. A listing description is not evidence of correspondence.
Planning conformity
Every building has an authorisation history: the original permit, subsequent works, and any amnesty relied upon. Works carried out without authorisation remain the responsibility of the property, not of the person who carried them out. This is the single most common source of unbudgeted cost after purchase.
Encumbrances, energy record and taxes
Mortgages, liens, rights of way, usufruct and seizure entries are recorded and can survive a sale unless discharged. An energy certificate must exist and be current at the deed. Purchase taxes differ by residence status and by whether the seller is a private party or a business.
Each of these has a named owner: the notary for the deed and the registry checks, the surveyor or engineer for the built state, the energy certifier for the certificate, the tax advisor for the fiscal position, the bank for financing conditions.

Can a foreign buyer complete a purchase in Italy?
Yes, subject to identification requirements, a tax code and, in some cases, reciprocity rules. The notary confirms the applicable conditions.
Who pays for unauthorised works discovered after purchase?
The obligation attaches to the property, so in practice the new owner bears it. Establishing planning conformity before the commitment is the reason this check exists.
